 DMV requires ignition interlock for drivers whose licenses are restored following a conviction for DWI if: 

  • You had an alcohol concentration of 0.15 or higher; or

  • You were convicted of a second offense of DWI, which happened within seven years of the offense for which your license was revoked; or

  • You were sentenced to an Aggravated Level One DWI

Ignition Interlock is required for ONE year if your license was originally revoked for one year. Ignition interlock is required for THREE years if your license was originally revoked for four years. Ignition interlock is required for SEVEN years if your license was originally revoked permanently.

Ignition Interlock violations are unfortunately very common. This is due to the very sensitive nature of the devices that you must blow into to start your engine. It is recommended that you keep your hands clean of any chemicals including hand sanitizer, avoid air fresheners and that you rinse your mouth with water before each blow.

If you had a fail or high blow, you should write down what you were doing and what you ate at the time just before you blew. This will be critical during your hearing as Attorney Haddock will argue that the high BAC was a false positive.
